TAICANG Workshop Legal & Tax (Chinese): "企业环境法风险控制, 应急处理及实际案例分析 / Enterprise’s Risk Control, Emergency Response under the PRC’s Environmental Law and Case Study"

在过去几年里，中国的环境政策、立法、行政执法和监管，以及司法环境都发生了巨大的变化。这给在中国投资或运营项目的企业带来了新的挑战。
In the past few years, China’s environmental policies, legislation, administrative law enforcement and supervision, as well as judicial environment, have been going through dramatic changes. This presents new challenges to enterprises that invest in or operate projects in China.

朱海婴律师，来自于浩天信和律师事务所，她将向大家概述环境规范的框架，并着眼于主要的实践操作问题。我们可以看到企业在污染防治方面的义务是如何显著增加的，以及随之而来的环境违法成本的增加。一方面企业面临更严峻的义务；另一方面，环境监管的执法力度也得到加强，如公开报告和投诉，中央政府对环境保护的监督和垂直的行政环境管理。
Ms. Annie Zhu (朱海婴律师) from Hylands Law Firm will provide an overview of the environmental regulatory framework and look at major practical issues. We will see how enterprises' obligations concerning pollution prevention and control have been increased significantly and so have the costs of environmental violations. On one hand, enterprises face more serious liabilities. On the other hand, environmental regulatory enforcement has been strengthened by supervision measures such as public reports and complaints, the central government's supervision of environmental protection and vertical administrative environmental management.

朱海婴律师将围绕企业的环境风险控制和应急响应作出讨论，其中包括:
1、企业的污染防治义务；
2、环境违法行为的重大责任，如：严厉的行政处罚、非政府组织或检察院提起的大额公益诉讼，甚至有可能涉及刑事处罚；
3、在环境违法的状况下的应急反应，例如：在公司受到环境行政处罚和环境诉讼等情况时聘请律师作为代理或顾问。
Ms. Annie Zhu will discuss enterprise’s environmental risk control and emergency response thereunder, including:

1. Enterprises' obligations concerning pollution prevention.
2. Serious liabilities for environmental violations, such as strict administrative penalties, large-value public interest litigation brought by NGOs (non-governmental organizations) or prosecution, and even possible criminal punishments.
3. Emergency response on environmental violation situation, e.g. engage lawyers as agents or consultants when the company is subject to environmental administrative penalties and environmental litigation, etc.
