课程背景 Course Background：

伴随《劳动合同法》的多年实施，对于用人单位于法律实践中的"弱势地位"，相当多的用人单位是越来越有深入认识。某种程度上，所有的单方解除，由于证据规则及审判政策导向的问题，都存在不确定性风险，唯有协商解除方才是最安全的选择，如此，如何开展有"说服力"的解除谈判，成为摆在大部分HR面前的难题。

More and more companies realize their vulnerability in legal practices under the current Labor Law which has been enforced for many years. There are large uncertainties in unilateral employment termination for changing trial standards and evidences required. So employment termination through negotiations is seemingly the best way, and how to conduct these negotiations convincingly becomes a difficult question for every HR person related.

此外，随着普通劳动者权利意识的觉醒，"抱团取暖"取暖所导致的群体争议亦时常发生。其中，最为令人头疼的，乃是所谓的"权益争议"，即尽管用人单位并没有违法，但由于工资问题或股权收购问题，仍存在劳动者不确定的"停工"威胁。

如何通过有效的沟通在内部调查中固定证据？如何劝服劳动者接受已有的补偿方案？如何在群体性事件中尽快恢复生产？都是颇受瞩目但又缺少"良方"的问题。

Besides, there are more and more collective labor disputes when ordinary workers become more aware of their rights by law. When employee salary or share acquisition issues are involved, the employer company, without breaching any law and regulations though, are more likely to be threatened by stop of business.

本次课程结合具体案例，将各种情境下的沟通技巧"倾囊而授"，以期对参会同仁的实践操作有所裨益。
