2020-2021 Top Ten Cases Review Meeting has been successfully held on April 14.


At the meeting, 63 cases was presented compactly with intensive highlights. MSC will co-organize a series of regular case sharing sessions (online or offline) with BPEC/LC to provide opportunities for QBPC members to learn more about the highlights of the cases and maximize internal sharing and communication. We are pleased to invite QBPC members to take active participation.We plan to hold more case sharing meetings every other week, and almost all nomination cases will be shared.

Aug. 20: New Balance's Experience against Parasite Brands and Exploration of Chinese Judiciary Practices

This is a milestone victory that New Balance secured in China against bad-faith trademark filers and parasite brands. After very thorough and detailed elaborations and calculation, taking into consideration of the contributing factors for punitive damages, the courts finally decided to award a total compensation of RMB 10.15 million. The sharing will discuss the litigation strategies in this case and other similar cases against parasite brands, challenges and solutions, as well as calculation and elaborations on damages.


During the 1st instance trial, the plaintiff applied for the behavior preservation (injunction order) as an interim remedy. The court also imposed the statutory maximum penalty for breaching the injunction order. This sharing will also explore the standard criteria and application of laws when adopting interim measures in an intellectual property lawsuit.
