By adopting in 2016 the General Data Protection Regulation, commonly known as the GDPR, the European Union had taken the lead in regulating how companies collect, keep, and process data. As data are at the core of every successful business model, understanding the scope of the GDPR, knowing the actors involved, and in particular ensuring full compliance is key for companies.
This seminar will focus on Data Protection in the European Union, currently one of the most prominent questions among lawyers and legal practitioners assisting companies in Shanghai.
Firstly, Fabien Roy, Lawyer and Partner at Hogan Lovells International Law Firm will give an introduction to EU GDPR for MedTech companies. The presentation will provide different scenarios where Chinese MedTech companies may be processing personal data of data subjects in the EU. The presentation will also outline key measures, policies, agreements that Chinese MedTech companies should have in place to comply with EU GDPR. It will also briefly touch upon the difference between EU GDPR and Chinese PIPL. On a side note, the presentation will also cover new legislative developments that will also impact the medical device industry (e.g. AI Act, EHDS).
A panel discussion will follow where Fabien Roy will be joined by other panelists, such as Ava Tu, lawyer and partner at Daldewolf, Jane Murphy Founder and Chair of the European Data Protection Office (EDPO), led by moderator Philippe Snel, Managing Director at DaWo Law Firm Shanghai. The panel discussion will allow these experts to share knowledge on legal considerations when investing in Europe, as well as the legal obligation for Chinese companies to appoint a data protection representative in the EU.
