在严格的劳动法框架下,传统的"签合同、交社保"的用工形式成本最高风险最大,而《劳务派遣暂行规定》实施后,派遣这一被广泛采用的灵活用工方式也受到严格打压。越来越多的企业开始探寻更丰富多元的用工方式组合。那么,面对多变的市场环境,企业是否有更为灵活的用工形式可以选择?实习生可以派遣吗?退休返聘应当注意哪些事项?业务外包人员如何进行管理?
另一方面,随着企业业务的多元化、国际化,关联企业之间调剂人力资源、将员工派往境外,或境外关联企业向境内委派外籍高管、又或者员工兼职于多家企业其中所涉及的就业管制、合同安排、异地管理、社保缴纳风险也往往成为争议的高发地带。上述问题不仅长期困扰着HR管理者,更直接关乎企业的成本和风险。
借此,我们邀请在弹性雇佣领域有丰富实战经验的劳动法专家洪律师,分享标准用工中如何拓展企业自主权,灵活用工中如何控制法律风险,降低企业成本。
Course background
Under the strict labor law framework, the traditional form of "signing a contract and paying social security" has the highest cost risk. After the implementation of the "Interim Provisions on Labor Dispatch", the widely used flexible employment method has also been severely suppressed. More and more companies are beginning to explore richer and more diverse combinations of employment methods. So, in the face of a changing market environment, do companies have more flexible employment options to choose from? Can interns be dispatched? What should I pay attention to when rehiring? How does a business out-sourcer manage it?
On the other hand, with the diversification and internationalization of the company's business, affiliated companies can reassign human resources, send employees overseas, or overseas affiliated companies assign foreign executives to the country, or employees work in multiple companies. The employment control, contractual arrangements, off-site management, and social security payment risks involved in these have often become controversial high-incidence areas. The above problems have not only plagued HR managers for a long time, but also directly related to the costs and risks of the enterprise.
