On April 28, 2025 (Monday), the QBPC will hold an online seminar on Defense of Prior Art. The patent legal system of China has been adopting a bifurcated system for the infringement and validity proceedings since the enactment of the Patent Law in 1984. The court for a patent infringement case has no power to determine the validity of a patent. Even for a patent having vulnerable validity prospect, the validity cannot be determined until the CNIPA issues a decision in the invalidity proceeding. How could the court for an infringement case get rid of the shackles brought about by the bifurcated system for a low-quality patent, solving the dispute in a swift manner? We invite Ms. XU Jing from King & Wood Mallesons, who has an extensive experience of almost 25 years, to introduce the prior art defense applied in China, which will include:


  • The historical development of the prior art defense in China
  • How the prior art defense is applied in the Chinese judicial practice
  • The difference between the prior art defenses in China and the United States
