Intercompany license agreements between the parent company in Germany and the subsidiary in China are of considerable importance in practice. With such license agreements, the Chinese subsidiary often receives the necessary intellectual property (e.g., know how) from the parent company to manufacture products for the Chinese market. One of the biggest challenges is the alignment of German and Chinese tax perspective. Also, most of the license agreements have to be registered with the Chinese authorities before license fees can be transferred abroad.
During the meeting we will talk about the requirements for registration, the registration procedure, payment, and tax issues for the four types of license agreements most important in practice:
o Trademark licenses
o Know-how licenses
o Patent licenses and
o Software licenses
Furthermore, practical tips will be given.
