More and more legal and liability questions have been arising due to the outbreak of COVID-19. Many companies may not be able to duly perform contractual obligations on time and face the question whether such failure of duly performing contractual obligations leads to a breach of contract and respective liabilities or whether such liabilities may be exempted under the legal concept of Force Majeure. What constitutes Force Majeure? What should companies do?

 

Companies are also facing challenges on how to properly handle employment relationships during the epidemic period. What should companies do, if an employee gets infected with COVID-19 after work resumption? Can companies lay off staff in the current situation? What has to be considered?


During this webinar, experts will share their insights on the questions surrounding Force Majeure, Contract and Employment Law. Topics include:

    Dr. Ulrike Glueck is Managing Partner of CMS, China Shanghai Office and head of Corporate Practice Area Group of CMS, China. She is a renowned China expert and one of the leading lawyers advising international companies on M&A transactions, investments and restructuring projects in China. After practicing law in Germany for several years, Ulrike has been working on-site in China since 1998 and has over 20 years experience in China-related work. She has advised a large number of companies in various industry sectors in projects relating to M&A, FDI, and restructuring. Ulrike also led the team in China to win a series of awards. These include Leading Firm for Corporate and M&A in China: Foreign Firms by Legal 500 in 2017-2020, Notable Firm for M&A: Foreign Firms by IFLR 1000 in 2017-2019.Ulrike has been recognised as one of China’s Top 100 Lawyers by CBLJ in 2016, 2017 and 2019.

Starting from 2017, Jeanette acted as the Vice Chair of HR Working Group of European Chamber of Commerce in China, and the Chair in 2019.     In October 2016, Dr. Sigrid Winkler was appointed Executive Chamber Manager at the German Chamber of Commerce in China | Shanghai and is in charge of the membership organization at the Chamber. Dr. Winkler joined the German Chamber earlier in spring 2016, initially as Project Manager Social Responsibility where she was responsible for the More than a Market initiative. Dr. Winkler holds a PhD in Political Science from Vrije Universiteit Brussel in Belgium and a bachelor’s degree in Chinese Studies from Vienna University. Before joining the German Chamber, she was Head of Office of the Austrian Academic Exchange Agency (OeAD) in Shanghai. Previously, Dr. Winkler managed international business development projects in China and Eastern Europe for Business Upper Austria, the economic agency of the regional government of Upper Austria. She has published numerous peer-reviewed articles on EU-China relations, and since 2002, she has been regularly coming back to China for shorter and longer-term stays.
